Terms of Use
These Terms and Conditions (the “Terms”) govern your access to and use of the website located at www.justicexpressflorida.com (the “Site”) and all related products, content, and services offered through the Site (collectively, the “Services”). The Services are provided by JusticeXpress, Inc., a Delaware Public Benefit Corporation qualified to transact business in the State of Florida (“JusticeXpress,” “we,” “us,” or “our”). By accessing or using the Site or purchasing any Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use the Site.
1. JusticeXpress Is Not a Law Firm; No Legal Advice; No Attorney-Client Relationship
JUSTICEXPRESS IS NOT A LAW FIRM AND DOES NOT PROVIDE LEGAL ADVICE. JusticeXpress is a legal-information and self-help document-preparation platform. We are not attorneys, and no employee, contractor, or representative of JusticeXpress is authorized to practice law in Florida or any other jurisdiction. Nothing on the Site — including any form, instruction, article, comparison chart, video, chatbot output, or communication with our staff — constitutes legal advice, a legal opinion, or a recommendation regarding the application of law to your particular facts.
Your use of the Site does not create an attorney-client relationship between you and JusticeXpress. Communications you send to us are not protected by the attorney-client privilege or the attorney work-product doctrine and may be reviewed by non-attorney personnel.
2. Self-Help Document Preparation Only
JusticeXpress offers fillable PDF legal forms and supporting informational content designed for Florida residents who are representing themselves pro se in civil legal matters. All forms are sold on a per-document basis. We do not offer subscriptions, retainers, packages of ongoing legal services, or representation of any kind. You alone are responsible for:
- Determining whether a particular form is appropriate for your situation;
- Completing the form accurately and truthfully;
- Confirming the current version required by the applicable court, clerk, or agency;
- Filing the form, paying any filing fees, and meeting any deadlines.
3. Legal Document Preparer Service
For an additional fee, JusticeXpress may offer a Legal Document Preparer Service (the “Review Service”). This Service is strictly limited to the following non-legal, clerical functions:
- Reviewing a completed form for typographical errors, blank or omitted fields, internal inconsistencies, and adherence to the form’s own published instructions;
- Confirming that the form you have selected matches the version currently published by the relevant Florida court or agency;
- Providing factual information about filing logistics — such as where to file, the clerk’s published filing fees, accepted methods of payment, and access to the Florida Courts E-Filing Portal.
The Review Service expressly EXCLUDES, and you may not rely on JusticeXpress for, any of the following, each of which constitutes the practice of law and must be obtained from a Florida-licensed attorney:
- Selecting the form, cause of action, or legal theory that applies to your case;
- Advising on the legal sufficiency of allegations, defenses, or evidence;
- Recommending litigation strategy, settlement positions, or negotiation tactics;
- Interpreting statutes, court rules, regulations, case law, or contract terms;
- Predicting outcomes or assessing the strength of any claim or defense;
- Drafting custom legal language or modifying official forms beyond filling in the blanks as instructed;
- Any other activity constituting the unlicensed practice of law under Chapter 454, Florida Statutes, or Rule 10-2.1 of the Rules Regulating The Florida Bar.
4. Florida Disclosure on the Unlicensed Practice of Law
Under Florida law, only a member in good standing of The Florida Bar may give legal advice or represent another person in a Florida court. Under Florida Family Law Rule of Procedure 12.750 and Rule 10-2.1(a) of the Rules Regulating The Florida Bar, a nonlawyer may type or assemble approved forms for self-represented persons but may not give legal advice. If you require legal advice, you should consult a licensed Florida attorney. The Florida Bar Lawyer Referral Service is available at www.floridabar.org or by phone at 1-800-342-8011.
5. Eligibility
You must be at least 18 years old and legally capable of entering into a binding contract to use the Services. By using the Site you represent that you meet these requirements and that the information you submit is accurate and complete.
6. Pricing, Payment, and Refunds
All Services are priced and sold on a per-document basis at the prices posted on the Site at the time of purchase. Prices are stated in U.S. dollars and exclude any taxes or third-party court filing fees, which remain your responsibility. We accept payment through the processors identified at checkout; by submitting payment information you authorize JusticeXpress and its processors to charge the applicable amount.
Because the Services consist of digital products that are delivered immediately upon purchase, all sales are final and nonrefundable, except (a) where required by applicable law or (b) where JusticeXpress, in its sole discretion, determines a refund is warranted — for example, where a duplicate charge has occurred or where the wrong document was delivered. Refund requests must be submitted in writing within thirty (30) days of purchase to support@justicexpressflorida.com.
7. License to Use Forms
Upon successful payment, JusticeXpress grants you a limited, nonexclusive, nontransferable, revocable license to download and use the purchased form solely for your own personal, noncommercial legal matter. You may not resell, redistribute, republish, sublicense, or incorporate any JusticeXpress form, instruction, or comparison content into any product or service offered to third parties. Many forms made available through the Site are based on official forms promulgated by the Supreme Court of Florida or other governmental bodies; the unmodified underlying forms remain in the public domain, and JusticeXpress claims no proprietary interest in those underlying public-domain forms themselves.
8. Intellectual Property
Except for public-domain government forms, all content on the Site — including text, graphics, logos, instructional guides, comparison tables, page layouts, software, and the look and feel of the Site — is the property of JusticeXpress or its licensors and is protected by United States and international copyright, trademark, and other intellectual-property laws. “JusticeXpress,” “JusticeXpress Florida,” and related names and logos are trademarks of JusticeXpress, Inc. and may not be used without our prior written consent.
9. User Conduct
You agree not to: (a) use the Site for any unlawful purpose; (b) misrepresent your identity or submit false information; (c) attempt to gain unauthorized access to any portion of the Site or its underlying systems; (d) interfere with or disrupt the Site, its security features, or other users; (e) scrape, harvest, or otherwise extract content from the Site by automated means; or (f) use the Site to harass any other person or to engage in conduct that would violate applicable law.
10. Third-Party Content and Links
The Site may contain links to, or descriptions of, third-party services — including pro se litigation coaching providers, court e-filing portals, lawyer-referral services, and informational websites. JusticeXpress does not endorse, control, or assume responsibility for any third-party content, services, products, or transactions. Any dealings you have with third parties are solely between you and the third party.
11. Privacy
Your use of the Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Site you consent to the data practices described in the Privacy Policy.
12. Disclaimers
THE SITE AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, TITLE, OR NONINFRINGEMENT. JUSTICEXPRESS DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE; THAT THE INFORMATION ON THE SITE IS CURRENT OR APPLICABLE TO YOUR SITUATION; OR THAT ANY FORM PURCHASED THROUGH THE SITE WILL BE ACCEPTED BY ANY COURT, CLERK, OR AGENCY. COURT RULES, FORMS, AND PROCEDURES CHANGE; YOU ARE SOLELY RESPONSIBLE FOR CONFIRMING THE CURRENT VERSION AND APPLICABLE PROCEDURE WITH THE RELEVANT COURT OR AGENCY BEFORE FILING.
13. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, JUSTICEXPRESS, ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUES, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE SITE OR SERVICES, EVEN IF JUSTICEXPRESS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE FULLEST EXTENT PERMITTED BY LAW, JUSTICEXPRESS’S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID TO JUSTICEXPRESS DURING THE NINETY (90) DAYS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100.00).
14. Indemnification
You agree to defend, indemnify, and hold harmless JusticeXpress and its officers, directors, employees, contractors, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to (a) your use of the Site or Services; (b) your violation of these Terms; (c) your violation of any law or the rights of any third party; (d) the content or accuracy of any information you submit through the Site; or (e) any legal proceeding to which the Services contributed.
15. Governing Law and Venue
These Terms are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict-of-laws principles. Subject to Section 16, you and JusticeXpress agree that any judicial proceeding arising out of or relating to these Terms or the Services shall be brought exclusively in the state or federal courts located in Port St. Lucie, Florida, and you irrevocably consent to the personal jurisdiction and venue of those courts.
16. Binding Arbitration; Class-Action Waiver
PLEASE READ THIS SECTION CAREFULLY — IT AFFECTS YOUR LEGAL RIGHTS.
Except for (a) claims for injunctive or equitable relief to protect intellectual-property rights and (b) claims that may be brought in small-claims court, any dispute, claim, or controversy arising out of or relating to these Terms or the Services shall be resolved by binding individual arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules, then in effect. The arbitration shall be conducted in the county of your residence, by telephone, or by video conference at your election. The arbitrator’s decision shall be final and binding, and judgment on the award may be entered in any court of competent jurisdiction.
YOU AND JUSTICEXPRESS AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person’s claims or preside over any form of representative or class proceeding.
30-Day Opt-Out. You may opt out of this arbitration provision by sending written notice of your decision to opt out to support@justicexpressflorida.com within thirty (30) days of first accepting these Terms. The notice must include your full name, mailing address, and a clear statement that you wish to opt out.
17. Changes to These Terms
JusticeXpress may modify these Terms from time to time. Material changes will be posted on the Site with an updated “Effective Date,” and where appropriate we will provide additional notice (such as by email or an on-Site banner). Your continued use of the Site after the effective date of any modification constitutes your acceptance of the modified Terms.
18. Termination
We may suspend or terminate your access to the Site or Services at any time, with or without cause and with or without notice. Sections 1, 2, 7, 8, 12, 13, 14, 15, 16, and 19 survive any termination.
19. Miscellaneous
These Terms, together with the Privacy Policy and any order confirmation you receive, constitute the entire agreement between you and JusticeXpress regarding the Services and supersede all prior or contemporaneous communications. If any provision of these Terms is held to be invalid or unenforceable, that provision shall be enforced to the maximum extent permissible and the remaining provisions shall continue in full force and effect. No waiver by JusticeXpress of any term or breach is a waiver of any other term or breach. You may not assign or transfer these Terms without our prior written consent; JusticeXpress may assign these Terms freely. Section headings are for convenience only and have no legal effect.
