Living Trusts

Skip probate. Keep it private.

A Florida revocable living trust lets your accounts and property pass to the people you name without a probate case, without a court file anyone can read, and without the delay. Prepared from your answers, reviewed by a trained preparer, and delivered with the funding instructions most online trust services leave out.

Living Trust — Single Person

For one Floridian with retirement or investment accounts, property, or anyone who wants the estate settled outside of court.

$199 flat fee
  • Florida Revocable Living Trust (Chapter 736)
  • Pour-Over Will — catches anything left outside the trust
  • Certificate of Trust (§736.1017) for banks and title companies
  • Durable Power of Attorney (§709.2101)
  • Living Will and Designation of Health Care Surrogate (§765)

A trust only controls what you actually put in it. This package covers accounts and beneficiary designations. To move real estate in, add the Deed to Trust for $99.

Living Trust — Married Couple

For spouses who want one plan that covers both of them — and leaves the survivor with clear instructions instead of a probate case.

$349 flat fee, both spouses
  • Joint Revocable Living Trust (Chapter 736) — or two separate trusts, your choice
  • Two Pour-Over Wills, one for each spouse
  • Certificate of Trust (§736.1017) for banks and title companies
  • Two Durable Powers of Attorney (§709.2101)
  • Two Living Wills and two Health Care Surrogate designations (§765)
  • Schedule of Trust Assets, completed with you
  • Funding checklist — joint accounts, retirement plans, and beneficiary updates
  • Survivor's instructions — what the surviving spouse does, and when
  • Preparer review before delivery

Two people, one flat fee — not two separate purchases. To move your Florida home into the trust, add the Deed to Trust for $99.

Add-on · or buy on its own

Deed to Trust — one Florida property

The step that makes a trust actually work for your home. Add it to either package above, or buy it alone if you already have a trust that was never funded.

  • Florida deed transferring one property into your trust
  • Prepared to your county Clerk's recording standards
  • Homestead language reviewed before delivery
  • Legal description pulled from your current deed
  • Step-by-step recording instructions for your county
  • Preparer review before delivery

Recording costs — and any documentary stamp tax that applies to your transfer — are paid directly to the county, separate from the $99 and never marked up. One property per deed; add another for $99. If your property is mortgaged or held with someone outside the trust, we'll tell you before you buy.

Not everyone needs a trust.

Plenty of Floridians are fine with a will. If your home is protected homestead passing to a spouse or child, and your accounts already have named beneficiaries, a trust may buy you very little. Read the comparison first — and if a will is enough for you, take the estate planning bundle instead. We'd rather sell you the smaller package than the wrong one.
