The forms are federal. What you put on them is governed largely by Florida law — and Florida is one of the most distinctive exemption states in the country. The manual is written around that.

Florida’s homestead protection

Florida’s constitutional homestead exemption is unlimited in value within acreage limits, subject to the federal 1,215-day cap on recently acquired homesteads. Schedule C is where that protection is claimed — and where it is lost if claimed incorrectly. Fla. Const. art. X, § 4; 11 U.S.C. § 522(p).

Florida has opted out of the federal exemptions

You cannot choose the federal exemption list here. Florida filers use the Florida list, including the statutory personal property exemption and the additional personal property exemption available to filers who do not claim a homestead. Fla. Stat. §§ 222.20, 222.25.

The domicile rule for recent arrivals

If you moved to Florida within the last two years, federal law may require you to use another state’s exemptions instead. The manual explains how to identify which state’s list applies to you before you complete Schedule C. 11 U.S.C. § 522(b)(3)(A).

Three districts, three clerks

Florida is divided into the Northern, Middle, and Southern Districts. The manual identifies which district and division your county falls in, and where and how the packet is filed once it is complete.

What’s at stake

Filing wrong is expensive. Not filing is worse.

Pro se Chapter 7 cases fail for boringly consistent reasons — almost all of them paperwork, almost all of them avoidable:

  • Missing the credit counseling certificate. The briefing has to be completed before you file. Without it, the case is subject to dismissal at the outset.
  • Forgetting the second course. The post-filing debtor education certificate is what gets the discharge entered. Cases have been closed without a discharge over this one form.
  • An incomplete Schedule C. Property not properly claimed as exempt is property the trustee can administer.
  • Leaving a creditor off the matrix. A debt you never listed is a debt that may follow you out of bankruptcy.
  • Doing nothing at all. In Florida, a money judgment can be recorded, renewed, and enforced against you for years while interest keeps running.

Before you buy

Can I really file Chapter 7 without a lawyer?

Yes. Federal law allows individuals to represent themselves in bankruptcy, and thousands of people file pro se every year. Whether it is a good idea depends on your case. Straightforward cases — ordinary consumer debt, income under the state median, no recent transfers of property, no business assets — are the ones people most often complete on their own. Complicated ones are not.

Are these the current official forms?

Yes. These are the official federal bankruptcy forms, supplied in Adobe fillable format, and we update the kit when the official forms are revised.

Does the $39.95 include the court’s filing fee?

No. The Chapter 7 filing fee is paid separately to the bankruptcy court and is currently $338. It can be paid in installments, or waived entirely if your household income is below 150% of the federal poverty guidelines. Both applications — Forms 103A and 103B — are in the kit, and the manual explains the difference.

Will someone review my completed forms?

Not in this product. This kit is priced for self-preparation and includes no document review. That is a deliberate trade-off, and it is why it costs $39.95 instead of several hundred.

What about the credit counseling requirement?

Federal law requires a credit counseling briefing from an approved provider within the 180 days before you file, and a separate debtor education course after filing. Those courses come from outside agencies, not from us. The manual explains what each one is, when it has to happen, and how the certificates get filed.

I live in Georgia (or anywhere outside Florida). Can I use this?

The forms are federal and used nationwide, but the manual’s exemption and filing guidance is written for Florida filers. If you file in another state, the exemption chapter will not match your case.

How do I actually get the forms? Do you email them?

No. Nothing is emailed. At checkout you create a Justice Xpress Vault account with your own username and password, and the kit appears in that account immediately. There is no delivery window and no link to wait for, because these are fillable forms with no document review attached.
