Florida rewards new residents who get the details right. It doesn't warn the ones who don't.
Moving here is a hundred decisions. The legal ones come with dates nobody mails you.
A lost year of homestead
Own and live in your home on January 1, file by March 1. Miss it and Florida law treats the exemption as waived for that whole year.
Your old state keeps taxing you
High-tax states audit people who leave. Without a clear paper trail of your Florida domicile, you can end up owing income tax to the state you moved away from.
Fines and a car you can't register
Ten days for Florida insurance and registration, thirty for a license. Late means penalties and a trip back to the tax collector.
The real problem is scattered rules. Your deadlines live with four different offices: the tax collector, the driver license office, the clerk of court and the property appraiser. Each one explains only its own piece.
You shouldn't need a lawyer on the clock to find out what day something is due.

How to establish Florida residency
Florida has no state income tax and no 183-day rule. You become a Florida resident through your actions and your intent to make Florida your permanent home. The state measures that intent by the records you create: a Florida driver license, Florida vehicle registration, voter registration at your Florida address, and, for many people, a recorded Declaration of Domicile.
Some of those steps carry firm deadlines. New residents must register their vehicles within 10 days and get a Florida driver license within 30 days. Homeowners who live in their home on January 1 can claim the homestead exemption by filing with the county property appraiser by March 1, which also starts the Save Our Homes cap on assessment increases.
In November 2026, Florida voters decide Amendment 3. If at least 60% approve, the homestead exemption on non-school property taxes grows to as much as $150,000 in 2027 and $250,000 in 2028, and people who establish residency after December 31, 2026 would wait about five years for the larger amount. The New Florida Resident Kit organizes every one of these steps around your own move-in date, so you finish each one on time and keep a record of when you did.
Before you buy
Is this legal advice?
No. JusticeXpress Florida provides legal information and prepares documents from the answers you give. We aren't a law firm. If your situation is complicated, for example you keep homes in two states, talk with a Florida-licensed attorney.
Do I have to file a Declaration of Domicile?
No, it's optional under Florida law. It's a sworn record of your intent to make Florida your permanent home, which is strong evidence if your former state ever questions your move. You sign it before a notary and record it with your county clerk, who charges a recording fee.
What's different about the Couple Kit?
It prepares a Declaration of Domicile for each spouse, puts both spouses' license and voter steps on one plan, includes the homestead steps for both owners, and sends reminders to both of you.
I moved months ago. Is it too late?
No. The planner shows anything past due so you can catch up first, and the homestead and Declaration of Domicile steps still matter long after your first month.
Do I need the estate planning documents too?
They're optional. Most new residents should at least review their will and replace an out-of-state power of attorney and health care surrogate with Florida versions. The package with Document Review costs less than buying the kit and the documents separately.
What does Document Review involve?
A trained Legal Document Preparer checks your completed documents for completeness and consistency with Florida requirements, notes anything that needs your attention, and returns them with signing instructions, usually within 1–2 business days. See what's included.
What if I'm not satisfied?
Our guarantee applies to the kit, and the guarantee FAQ explains how it works.

Deadlines and fees described here are current as of October 2026 and can change. Amendment 3 is a proposed constitutional amendment on the November 3, 2026 ballot and takes effect only if approved by at least 60% of voters.
