Florida Chapter 7 Screener
Nine minutes of questions. At the end you get a written summary of the Florida rules that touch your situation, the issues worth raising with an attorney, and an honest answer to one question: is this a case you can file yourself, or not?
This tool does not decide anything. It sorts your answers into published Florida and federal rules and tells you which ones to read. It cannot tell you whether to file, whether you qualify, or what property you can protect — only a licensed Florida attorney can do that. Justice Xpress Florida is not a law firm.
Step 1 of 5 · Household and income
Where does your income sit against the Florida median?
This is not the means test. It is the first comparison the means test forms ask you to make, and it decides which forms you have to complete. The figures below are published by the U.S. Trustee Program from Census Bureau data.
Florida median family income · cases filed on or after July 15, 2026
| Household size | Median |
|---|---|
| 1 | $69,876 |
| 2 | $86,523 |
| 3 | $97,540 |
| 4 | $114,761 |
| Each additional person | + $11,100 |
Household size is defined differently by different courts, and a non-filing spouse’s income usually still counts. Use your best count for now.
Everything before taxes and deductions, from everyone in the household — wages, self-employment, unemployment, rental income, regular contributions from others. Leave out Social Security benefits; the means test excludes them.

Six threshold questions
These are the rules that decide whether a Chapter 7 case can be filed at all right now, or whether the timing is wrong. “Not sure” is a real answer — it just means we flag it.
Have you received a Chapter 7 discharge in the last 8 years?
Have you received a Chapter 13 discharge in the last 6 years?
Has a bankruptcy case of yours been dismissed in the last 12 months?
Have you lived in Florida continuously for at least the last 2 years?
Are most of your debts personal debts — credit cards, medical bills, car loans, personal loans — rather than business debts?
Have you completed a credit counseling briefing from a court-approved provider in the last 180 days?
Answer all six questions to continue.
What else is going on?
Check everything that applies. Nothing here disqualifies you from bankruptcy — these are the facts that turn a simple case into a complicated one. Leave a box unchecked if it doesn’t apply.
What do you own?
Florida has opted out of the federal exemption list, so what you keep is governed by the Florida Constitution and Florida Statutes. Check what applies and we’ll build you a reading map of the exemptions that touch it — with the citation for each one.
