Living Trusts

Skip probate. Keep it private.

A Florida revocable living trust lets your accounts and property pass to the people you name without a probate case, without a court file anyone can read, and without the delay. Prepared from your answers, reviewed by a trained preparer, and delivered with the funding instructions most online trust services leave out.

Prepared & Reviewed

Living Trust — Single Person

For one Floridian with retirement or investment accounts, property, or anyone who wants the estate settled outside of court.

$199 flat fee
  • Florida Revocable Living Trust (Chapter 736)
  • Pour-Over Will — catches anything left outside the trust
  • Certificate of Trust (§736.1017) for banks and title companies
  • Durable Power of Attorney (§709.2101)
  • Living Will and Designation of Health Care Surrogate (§765)

  • Successor trustee instructions — what happens next, and who does it
  • Preparer review before delivery

A trust only controls what you actually put in it. This package covers accounts and beneficiary designations. To move real estate in, add the Deed to Trust for $99.

Prepared & Reviewed · Couples

Living Trust — Married Couple

For spouses who want one plan that covers both of them — and leaves the survivor with clear instructions instead of a probate case.

$349 flat fee, both spouses
  • Joint Revocable Living Trust (Chapter 736) — or two separate trusts, your choice
  • Two Pour-Over Wills, one for each spouse
  • Certificate of Trust (§736.1017) for banks and title companies
  • Two Durable Powers of Attorney (§709.2101)
  • Two Living Wills and two Health Care Surrogate designations (§765)
  • Schedule of Trust Assets, completed with you
  • Funding checklist — joint accounts, retirement plans, and beneficiary updates
  • Survivor's instructions — what the surviving spouse does, and when
  • Preparer review before delivery

Two people, one flat fee — not two separate purchases. To move your Florida home into the trust, add the Deed to Trust for $99.

Add-on · or buy on its own

Deed to Trust — one Florida property

The step that makes a trust actually work for your home. Add it to either package above, or buy it alone if you already have a trust that was never funded.

  • Florida deed transferring one property into your trust
  • Prepared to your county Clerk's recording standards
  • Homestead language reviewed before delivery
  • Legal description pulled from your current deed
  • Step-by-step recording instructions for your county
  • Preparer review before delivery

Recording costs — and any documentary stamp tax that applies to your transfer — are paid directly to the county, separate from the $99 and never marked up. One property per deed; add another for $99. If your property is mortgaged or held with someone outside the trust, we'll tell you before you buy.

$99 flat fee, per property Add the Deed →

Not everyone needs a trust.

Plenty of Floridians are fine with a will. If your home is protected homestead passing to a spouse or child, and your accounts already have named beneficiaries, a trust may buy you very little. Read the comparison first — and if a will is enough for you, take the estate planning bundle instead. We'd rather sell you the smaller package than the wrong one.

The difference

A human checks your paperwork before you file.

Included with every prepared-and-reviewed package above. Our preparers verify your completed documents, flag what’s missing, and confirm where and how to file in your county — so your filing isn’t rejected over a fixable error.

A Legal Document Preparer is not an attorney and cannot tell you which form to use or give legal advice.

  • Every required field reviewed for completeness
  • County-specific filing & service guidance
  • Spelling, dates, and consistency checked
  • Returned ready to file with confidence

Our promise on what’s free

We’ll never charge you for a form that’s already free and automated elsewhere — like the Florida courts’ DIY portal or FloridaLawHelp.org. When that’s the case, we point you straight to it. What you pay for is the value the court doesn’t give you: a blank PDF turned into a guided, reviewed, ready-to-file document.

Common questions

Do I file the documents myself?

Yes — and that’s the point. We prepare and review everything and give you exact county steps; you file, stay in control, and keep the savings.

Is this legal advice?

No. JusticeXpress is a document preparation service, not a law firm. We prepare your documents and explain the law; we can’t advise which form to use for your situation.

Are filing fees included?

No — and we never mark them up. Court and state fees are paid directly to the clerk or Sunbiz. We tell you the exact amount for your county.

Is there a subscription?

Never. Every package is one flat fee. You pay once, only for what you need.

What if my form is free elsewhere?

We’ll tell you. If it’s already free and automated, we point you to it rather than charge you.

How do I get my documents?

You answer questions online and your documents are delivered to your secure JusticeXpress Vault, with filing instructions.

Not sure which package fits?

Start free. Browse the law for your situation, then come back when you’re ready to act.

Lady Bird Deed

Enhanced Life Estate Deed · one Florida property

The simplest way to keep your Florida home out of probate. You stay the owner for life — free to sell, mortgage, refinance, or change your mind without asking anyone — and when you pass, the home goes straight to the people you named. No court case, no trust to maintain.

  • Enhanced Life Estate Deed for one Florida property
  • Retained powers — sell, mortgage, or revoke without beneficiary consent
  • Remainder beneficiaries you name, in the shares you choose
  • Legal description taken from your current recorded deed
  • Drafted to keep your homestead exemption and Save Our Homes cap intact
  • Recording instructions for your county Clerk
  • Preparer review before delivery
  • Delivered to your secure JusticeXpress Vault

When a Lady Bird deed is the better buy than a trust. If your home is your main asset and your accounts already name beneficiaries, this $99 deed may do everything a living trust would have done for you. A trust earns its cost when there are multiple properties, out-of-state real estate, minor children, or a beneficiary who shouldn't inherit outright.

Recording costs — and any documentary stamp tax that applies to your transfer — are paid directly to your county, separate from the $99 and never marked up. One property per deed; add another for $99. If the property is mortgaged, co-owned, or if Medicaid planning is your main reason for doing this, tell us at intake — that last one is a question for a Florida elder law attorney, and we'll say so rather than sell you a form.
