Why the Mental Health Advance Directive matters

Mental-health emergencies are now the largest category of campus medical incidents, and Florida’s Baker Act allows a 72-hour involuntary psychiatric hold on a single professional’s determination. Once your child is admitted, HIPAA’s psychotherapy-notes rule can lock family out — even family named on a standard release. This directive is the separate instrument that keeps you able to help. If your child has an existing mental-health diagnosis, consult a Florida attorney and their treating provider before executing it.

Does my child have to sigThe College Send-Off Legal Checklist n?
Yes — and only your child can. These are your adult child’s documents: they’re the ones granting you access to their information and the authority to act. Your eighteen-year-old signs each one (with witnesses or a notary as the document requires); a parent can’t sign on their behalf. That’s exactly why this matters at eighteen — they’re now the only person who can let you in.
Can these be signed electronically?
Some can, and some are best signed on paper with witnesses so hospitals and institutions honor them without question. Every document in your packet comes with plain-language signing instructions telling you exactly how to execute it — ink, witnesses, or notary — so it holds up when you need it.
What if they attend school in another state?
That’s the Host-State Companion Pack. Buy the Florida pack and we include a matching set prepared under your student’s school-state law free, so out-of-state hospitals and universities recognize it. If you only need the out-of-state set, it’s available on its own for $69.
Do they expire?
No — none of these has a built-in expiration date. They stay in effect until your child revokes or replaces them. It’s still smart to refresh them if life changes — a new school, a new state, marriage — or every few years, so institutions treat them as current.
Can I buy just one form?
Yes. The seven-document pack is the best value by far, but individual documents are available if you only need, say, a HIPAA authorization or a durable power of attorney. Just ask and we’ll point you to the right one.
Will colleges accept these?
Colleges and hospitals routinely accept properly executed HIPAA authorizations, FERPA releases, and powers of attorney. One tip: many colleges also keep their own FERPA form in the student portal — our authorization covers the federal requirement, and if your child’s school wants its own on file too, we’ll flag it so nothing slips.
